Secure Bike Share Hawaii LLC (“SBSH”) and People for Active Transportation Hawaii (“PATH”), (Doing business as “HIBIKE”), (collectively “HIBIKE”,  "we” ,"us” , or " our")  are committed to maintaining your confidence and trust.  Therefore, we maintain the following privacy policy to help individuals using our services ("Rider", "You", "User", or "Your") understand how we collect, use, share, and protect the personal information you provide to us through hawaiiislandbike.com (the “Site”), our bike share kiosks, bicycles, docking stations, customer service center, and any authorized mobile application (collectively, the “Services”). This Policy comes into effect from the date when the User begins utilizing our services or engages with any of the associated equipment ("Services").

HIBIKE reserves the right to amend, modify or change this Privacy Policy at any time and without your consent. We will post notice of this privacy policy on Hawaiiislandbike.com and other authorized locations  that point to this Privacy Policy to notify you of any substantive changes. Please review this Privacy Policy on a regular basis to maintain awareness of any amendments, modifications, or changes. The last update to this Privacy Policy will be posted at the top of the document and any changes made will be logged below with an effective date and summary of changes. Use of our site, any of our products and services following changes to this Privacy Policy constitutes your acceptance of the revised Policy then in effect.

  1. Information Hibike May Collect

 

You may browse our website without purchasing a Membership. However, if you register for a Membership and or use the service, HIBIKE may collect the following types of personally identifiable information:

 

Account Information: full name, gender, email address, phone number, date of birth, shipping address, billing credentials; credit card or debit card number, expiration date, authorization number or security code, billing address.

Customer Service: e-mail messages, text messages, call logs.

 

HIBIKE may also collect non-personally identifiable information, data that cannot be used on its own to identify a person, such as traffic patterns and usage statistics.  This includes, but is not limited to:

 

Trip Information: Bicycle identification numbers, trip start station, trip end station, trip start time, trip end time, geo location data; physical locations and routes taken.

 

Certain products my require that you provide a copy personal documents such as a government issued ID or other supporting documents. By sharing any personal information you authorized the collection and storage of these documents.

 

The Site contains links to other sites.  Please be aware that HIBIKE is not responsible for the content or privacy policies of such other sites.  We encourage our users to be aware when they leave our site and to read the privacy policy of any other site that collects personally identifiable information.

HIBIKE may use the information collected through the Site or the Services for the following purposes, including, but not limited to:

Personally identifiable information: Hibike uses this information in order to provide services, process orders, responding to customer service requests, conducting market research, promotions, and marketing, improving the Site or the Services, informing authorities and/or insurers in the case of; an accident, legal obligation, or in good faith.

 

B.) Non-personally identifiable information: Hibikes uses this information in order to improve our services, marketing, analytics, and improve transportation infrastructure.

 

C.) Geographic location data: Hibike may use this data to prioritize rider safety, deter bike theft, and enhance our services. This data helps us optimize bike deployment, track routes, and ensure timely bike availability. Hibike may use this data to locate an overdue or suspected stolen or lost bicycle; assisting in the event of an emergency; complying with applicable laws; and to protect the interests, rights, safety, or property of Ours or others. This data may be used collectively to identify the user in criminal or legal situations.

 

We do not sell your personal information.

 

  1. Who information is Shared With

 

Except as prohibited by law, HIBIKE may share your information with the following third parties, including, but not limited to:

 

A.)  Authorized Partners: We share your information with authorized partners, service providers, contactors, and third parties; for back-end support, advertising, marketing, or to perform other activities such as billing and collections.

 

B.) Third Party Collaboration: Your non-personally identifiable information may be shared with selected third parties for the purpose of research, traffic patterns, or business cases.

 

C.) Government and law enforcement agencies: Identifiable information may be shared in good faith when we believe it is reasonably necessary to do so in order to detect, prevent, or investigate any and all illegal activity.

 

D.) Sale or Merger: In the event of a sale or merger of the company or any subsequent operator of the Site and the Services, and as otherwise stated in this Privacy Policy.

 

  1. Computer and mobile device

 

HIBIKE uses cookies on the Site.  A cookie is a piece of data stored on a site visitor’s hard drive to help us improve your access to the Site and identify repeat visitors to the Site.  For example, we may use a cookie to identify you, to determine user traffic patterns, or enhance the visitor’s experience on the Site.  You may choose to disable your cookies or refuse to accept a cookie, but you may not be able to access all areas or features of the Site without your browser accepting cookies.

 

HIBIKE will also collect Internet Protocol (IP) addresses, the type of browser the visitor is using, the type of computer operating system, the domain name of the website that you used to access the Site, and travel information without personally identifiable information attached.

How your information is collected and shared is your right. If you do not agree fully to this Privacy Policy or wish for your information to not be collected or shared, do not use our services. You have the right to change and update your personal account information at any time through your account profile. You may also view your account related activity such as trip history and invoicing at any time when logged into your account on our website.

HIBIKE's Site and Services are not intended for users under the age of 18 (or 16 with parent or legal guardian’s consent), and, as such, does not knowingly collect personal information from anyone under the age of 18 (or 16 with parent or legal guardian’s consent).  If you are under the age of 18 without parent or legal guardian’s consent, please do not use the Site or the Services and do not submit any personal information to HIBIKE.  If a parent or guardian becomes aware that his or her child under the age of 18 has provided us with personal information without his or her consent, he or she should contact us at info@hawaiiislandbike.com and we will delete such information from our files.
